For Project: Montenegro—Capacity Building and Improved Legal Harmonization, Performance and Efficiency within the Transport Sector
Our project strengthens Montenegro’s transport sector by enhancing institutional capacity, aligning national legislation with EU transport acquis, and advancing the preparation and implementation of priority transport projects.
The initiative focuses on improving strategic planning, legal harmonization in areas like road safety and maritime transport and developing priority infrastructure projects to a mature stage. These efforts contribute to creating a more efficient, sustainable, and EU-compliant transport system in Montenegro.
DAI is looking to recruit a Senior Non-Key Expert (SNKE) - Expert for drafting Law amending the Law on Roads and Rulebook on the detailed method, technical requirements, special conditions and elements of interoperability of electronic toll collection
Overall objective
Overall objective of this assignment is to harmonize MNE legislation on road infrastructure with the identified body of EU Acquis related to levying of tolls and vignettes and ITS in order to successfully fullfil the related part of CB1 by the end of 2025 and subsequently the closing of Chapter 14. This assignment will also contribute to achieving some of the Next Generation TCT Action Plans measures related to those fields.
Specific objectives:
Specific objective of this short-term assignment is harmonizing Law on amending the Law on Roads and one by-law related with the identified
EU Acquis related to levying of
tolls and
vignettes and
ITS.
- Outcome 1 is creating Draft Law amending the Law on Roads harmonized with the Directive 2661/2023 amending Directive 2010/40/EU on the framework for the deployment of Intelligent Transport Systems in the field of road transport and for interfaces with other modes of transport (ITS Directive) with the accompanying Table of Concordance.
- Outcome 2 is creating Draft Law amending the Law on Roads harmonized with the Directive (EU) 2019/520 on the interoperability of electronic road toll systems and facilitating cross-border exchange of information on the failure to pay road fees in the Union (recast, consolidated version) with the accompanying Table of Concordance .
- Outcome 3 is creating Draft Law amending the Law on Roads harmonized with Directive 2022/362 amending Directives 1999/62/EC, 1999/37/EC and (EU) 2019/520 as regards the charging of vehicles for the use of certain infrastructures with the accompanying Table of Concordance
- Outcome 4 is drafting the legal ground in the Draft Law amending the Law on Roads enabling further harmonization at the level of secondary legislation with the following EU Acquis instruments:
- Commission Decision 2348/2024 amending Commission Decision 2011/C 135/03
- Commission Delegated Regulation (EU) 2020/203
- Commission Implementing Regulation (EU) 2020/204 repealing Decision 2009/750/EC
- Outcome 5 is to draft Rulebook on amendments to the Rulebook on the detailed method, technical requirements, special conditions and elements of interoperability of electronic toll collection with the following EU Acquis:
- Directive (EU) 2019/520 on the interoperability of electronic road toll systems and facilitating cross-border exchange of information on the failure to pay road fees in the Union
- Commission Delegated Regulation (EU) 2020/203 on classification of vehicles, obligations of European Electronic Toll Service users, requirements for interoperability constituents and minimum eligibility criteria for notified bodies
- Commission Implementing Regulation (EU) 2020/204 on detailed obligations of European Electronic Toll Service providers, minimum content of the European Electronic Toll Service domain statement, electronic interfaces, requirements for interoperability constituents and repealing Decision 2009/750/EC)
- Commission Decision 2348/2024 amending Commission Decision 2011/C 135/03
- Outcome 6 is to create 4 Tables of Concordance showing achieved harmonization of the draft Rulebook on amendments to the Rulebook on the detailed method, technical requirements, special conditions and elements of interoperability of electronic toll collection with the following EU Acquis:
- Directive (EU) 2019/520 on the interoperability of electronic road toll systems and facilitating cross-border exchange of information on the failure to pay road fees in the Union
- Commission Delegated Regulation (EU) 2020/203 on classification of vehicles, obligations of European Electronic Toll Service users, requirements for interoperability constituents and minimum eligibility criteria for notified bodies
- Commission Implementing Regulation (EU) 2020/204 on detailed obligations of European Electronic Toll Service providers, minimum content of the European Electronic Toll Service domain statement, electronic interfaces, requirements for interoperability constituents and repealing Decision 2009/750/EC)
- Commission Decision 2348/2024 amending Commission Decision 2011/C 135/03
- Outcome 7 of the assignment is knowledge transfer for the MoT officers from the Directorate for Road Infrastructure on the amendments introduced to the Law amending the Law on Roads, thus strengthening the administrative capacities within the MoT.
The
general scope of work under this short-term assignment is to harmonize MNE primary and secondary legislation related to charging for the use of road infrastructure with the EU Acquis on levying tolls or vignettes and ITS, in order to enable reaching part of the Closing Benchmark 1 as defined in the EC Indicative Guidelines:
“Where tolls or vignettes are levied, Montenegro must ensure alignment with Directive 1999/62/EC as well as interoperability of toll payment methods in line with Directive (EU) 2019/520 and its Implementing acts (Commission Implementing Regulation (EU) 2020/204) and Delegated Regulations (Commission Delegated Regulation (EU) 2020/203).”
Such harmonization will further enable accomplishing measures defined by Next Generation TCT Action Plans under the pillar “ITS Deployment on Core / Comprehensive Road Network”, namely:
- Transposition of Directive on the framework for the deployment of Intelligent Transport Systems in the field of road transport and for interfaces with other modes of transport
- Establishment of the National Access Points and National Bodies
Specific work
The SNKE has the following responsibilities under this assignment:
- Create Draft Law amending the Law on Roads harmonized with the following EU Acquis, together with accompanying Tables of Concordance:
- Directive 2661/2023 amending Directive 2010/40/EU on the framework for the deployment of Intelligent Transport Systems in the field of road transport and for interfaces with other modes of transport (ITS Directive)
- Directive (EU) 2019/520 on the interoperability of electronic road toll systems and facilitating cross-border exchange of information on the failure to pay road fees in the Union (recast, consolidated version)
- Directive 2022/362 amending Directives 1999/62/EC, 1999/37/EC and (EU) 2019/520 as regards the charging of vehicles for the use of certain infrastructures
- Create connecting provisions in the Draft Law amending the Law on Roads enabling further harmonization at the level of secondary legislation with the following EU Acquis instruments:
- Commission Decision 2348/2024 amending Commission Decision 2011/C 135/03
- Commission Delegated Regulation (EU) 2020/203
- Commission Implementing Regulation (EU) 2020/204 repealing Decision 2009/750/EC
- Create Rulebook on amendments to the Rulebook on the detailed method, technical requirements, special conditions and elements of interoperability of electronic toll collection created, harmonized with the following EU Acquis, toghether with the accompanying Tables of Concordance:
- Directive (EU) 2019/520 on the interoperability of electronic road toll systems and facilitating cross-border exchange of information on the failure to pay road fees in the Union
- Commission Delegated Regulation (EU) 2020/203 on classification of vehicles, obligations of European Electronic Toll Service users, requirements for interoperability constituents and minimum eligibility criteria for notified bodies
- Commission Implementing Regulation (EU) 2020/204 on detailed obligations of European Electronic Toll Service providers, minimum content of the European Electronic Toll Service domain statement, electronic interfaces, requirements for interoperability constituents and repealing Decision 2009/750/EC)
- Create Final Mission Report showing daily liaising with MoT Directorate for Road Infrastructure officer(s), enabling smooth enforcement and knowledge transfer on the implementation of the amended Law on Roads and the By-law.
- Any changes made to the specific provisions of the ToR of the project and the Contractor's offer regarding the performance of the above tasks shall be subject to agreement with the KE2, Team Leader, Contractor and project beneficiaries. An expert cannot propose or accept any changes or make any changes to project activities without the prior approval of KE2 and the Team Leader.
Required Qualifications and Experience:
- Qualification (educational background)
- University degree in law/transport sciences/technical sciences (where a university degree has been awarded on completion of four years of study in a university or equivalent institution) (required)
- General professional experience
- Minimum 10 years general professional experience (required)
- Specific professional experience
- Experience in harmonization of the national legislation with the EU Acquis (required)
- Experience on EU funded projects (preferred)
- Language skills
- Good knowledge of the English language (required)
- Knowledge of Montenegrin/Croatian/Serbian language (preferred)
- Additional assets
- Computer literacy, incl. MS Office applications (preferred)
