For Project: Montenegro—Capacity Building and Improved Legal Harmonization, Performance and Efficiency within the Transport Sector
Our project strengthens Montenegro’s transport sector by enhancing institutional capacity, aligning national legislation with EU transport acquis, and advancing the preparation and implementation of priority transport projects.
The initiative focuses on improving strategic planning, legal harmonization in areas like road safety and maritime transport and developing priority infrastructure projects to a mature stage. These efforts contribute to creating a more efficient, sustainable, and EU-compliant transport system in Montenegro.
Assignment:
Task 2.1 - Alignment of national legislation with outstanding EU Acquis under the Chapters 14 and 21
Overall objective
In order to fulfil such a demanding harmonization agenda there is an urgent need for legislative drafting support in the aviation sector, which entails efficient harmonization planning under the foreseen, tight EC deadlines. Overall objective is to ensure that system of laws governing aviation is fully harmonized with EU aviation Acquis as well as the underlying system of international aviation rules and standards (ICAO) as defined by the BNM 4, point 2 of the 2025 EC Indicative Guidelines.
Specific objectives
- Outcome 1 of this short-term assignment is to harmonize the Law on Air Transport with the provisions related to ATM in the Regulation 2018/1139 (Consolidated version), comprising Chapter I, Chapter II, Chapter III – Sections V and VI, Chapter IV, Chapter VI and Annex VIII of this Regulation.
- Outcome 2 of this short-term assignment is to harmonize the Law on Air Transport with the Regulation (EC) 1008/2008 (recast, consolidated version).
- Outcome 3 of the short-term assignment is to draft legal ground in the Law on Air Transport enabling further harmonization at the level of secondary legislation with the following EU Acquis instruments:
- Commission Implementing Regulation (EU) 2023/1772.

- Implementing Regulation (EU) 2017/373 (consolidated text)

- Outcome 4 of the short-term assignment is to provide training and knowledge transfer to the MoT Directorate for Aviation and MNE CAA on the amendments to the draft Law on Air Transport as harmonized with the above EU aviation Acquis.

Senior Non-Key Expert: Legal expert for harmonisation of Law on Air Transport
Specific work - The SNKE has the following responsibilities under this assignment:
- Prepare Draft Law on Air Transport harmonized with:
- Provisions related to ATM in the Regulation 2018/1139 (Consolidated version) - Chapter I, Chapter II, Chapter III – Sections V and VI, Chapter IV, Chapter VI and Annex VIII with the accompanying Table of Concordance;
- Regulation (EC) 1008/2008 (recast, consolidated version) with the accompanying Table of Concordance;
- Prepare Draft Law on Air Transport including provisions foreseeing further harmonization at the secondary legislation level (by-laws) with the following EU Acquis:
- Commission Implementing Regulation (EU) 2023/1772.

- Implementing Regulation (EU) 2017/373 (consolidated text)

Commission Regulation (EC) No 2150/2005
- Liaise daily with officer(s) from the MoT Directorate for Aviation, Civil Aviation Agency as well as the members of the Working Group for drafting Law on Air Transport in order to ensure knowledge transfer and training of the stakeholders on the new harmonized norms of the Law on Air Transport.
Place of work: Podgorica, Montenegro (home-base work not accepted)
Start date : The implementation of this activity should start as soon as possible, upon approval by the EUD.
Period of implementation of tasks: September 2025 – November 2025

Requirements:
Qualification (educational background)
- University degree (where a university degree has been awarded on completion of four years of study in a university or equivalent institution) and 10 years of professional experience related to the aviation, in addition to those required under general professional experience (required)
General professional experience
- Minimum 10 years general professional experience (required)
Specific professional experience
- Experience in drafting or implementing the aviation legislation (required)
- Experience in harmonization of transport laws under the TA or similar assistance projects (preferred)
Language skills
- Excellent knowledge of the English language (required)
- Knowledge of Montenegrin/Croatian/Serbian language (preferred)
Additional assets
- Computer literacy, incl. MS Office applications (preferred)
