For Project: Montenegro—Capacity Building and Improved Legal Harmonization, Performance and Efficiency within the Transport Sector
Our project strengthens Montenegro’s transport sector by enhancing institutional capacity, aligning national legislation with EU transport acquis, and advancing the preparation and implementation of priority transport projects.
The initiative focuses on improving strategic planning, legal harmonization in areas like road safety and maritime transport and developing priority infrastructure projects to a mature stage. These efforts contribute to creating a more efficient, sustainable, and EU-compliant transport system in Montenegro.
DAI is looking to recruit a Senior Non-Key Expert (SNKE) - Expert for drafting Law amending the Law on Roads and 2 accompanying By-laws on safety of roads and tunnels
Overall objective
Overall objective of this assignment is to harmonize MNE legislation on road infrastructure with the identified body of EU Acquis related to the safety of road infrastructure and tunnels.
This assignment will also contribute to achieving some of the Next Generation TCT Action Plans measures related to those fields.

Specific objective of this short-term assignment is harmonizing MNE legislation with the identified
EU Acquis related to the
safety of road infrastructure and tunnels.
- Outcome 1 is creating Draft Law amending the Law on Roads harmonized with Directive 2004/54/EC on minimum safety requirements for tunnels in the Trans-European Road Network (consolidated version) and accompanying Table of Concordance.
- Outcome 2 is creating Draft Rulebook amending Rulebook on minimum safety conditions that must be met in tunnels harmonized with Directive 2004/54/EC on minimum safety requirements for tunnels in the Trans-European Road Network (consolidated version) and accompanying Table of Concordance.
- Outcome 3 is creating Draft Law amending the Law on Roads harmonized with Directive (EU) 2019/1936 amending Directive 2008/96/EC on road infrastructure safety management (consolidated text) and the accompanying Table of Concordance.
- Outcome 4 is creating the Rulebook on Amendments to the Rulebook on the Method of Assessing the Impact of State Roads on Traffic Safety, Revision and Verification of Safety of the State Roads with Directive (EU) 2019/1936 amending Directive 2008/96/EC on road infrastructure safety management (consolidated text) and the accompanying Table of Concordance.
- Outcome 3 of the assignment is knowledge transfer for the MoT officers from the Directorate for Road Infrastructure on the amendments introduced to the Law amending the Law on Roads and the two Rulebooks, thus strengthening the administrative capacities within the MoT.
The
general scope of work under this short-term assignment is to enable comprehensive harmonization of the Draft Law amending the Law on Roads with all the EU Acquis relevant for this legislative instrument in order to complete its harmonization in the most time- and resource effective manner. Harmonization of this legislative instrument is currently also on-going with respect to the EU Acquis identified as part of the CB1 (ITS and tolling system). Simultaneous harmonization of the same Law with the outstanding body of EU Acquis on safety of roads that is not identified as being part of the CB1 (and thus generally not prioritized by Q4 2025) at the same time is logical and needed, in order to finalize this legislative instrument entirely and promulgate it by the end 2025.
This short-term assignment will enable (fully or partly) accomplishment of several measures planned under the Next Generation TCT Action Plans under the pillar “Promote safer infrastructure” before the planned deadlines, namely:
- Implementation of the Road Infrastructure Safety Management Directive and its amendment Directive (planned for Q2 2026)
- Implementation of the Directive on Minimum Safety Requirements for Tunnels (planned for Q2 2026)
- Establish and enforce adequate speed limits supported by appropriate safety measures, such as road signs, speed cameras, and other speed-restricting mechanisms, to ensure the safety of all road users (planned for Q4 2026)
- Develop specific programmes for the protection of vulnerable road users and, in particular, for the safety of pedestrians, cyclists and powered two-wheelers by appropriate infrastructure design and speed management (planned for Q1 2027)
Specific work
The SNKE has the following responsibilities under this assignment:
- Create Draft Law amending the Law on Roads harmonized with:
- Directive 2004/54/EC on minimum safety requirements for tunnels in the Trans-European Road Network (consolidated version)
- Directive (EU) 2019/1936 amending Directive 2008/96/EC on road infrastructure safety management (consolidated text)
- Create 2 Tables of Concordance showing level of harmonization of Draft Law amending the Law on Roads with:
- Directive 2004/54/EC on minimum safety requirements for tunnels in the Trans-European Road Network (consolidated version)
- Directive (EU) 2019/1936 amending Directive 2008/96/EC on road infrastructure safety management (consolidated text)
- Create Rulebook amending Rulebook on minimum safety conditions that must be met in tunnels created, harmonized with Directive 2004/54/EC on minimum safety requirements for tunnels in the Trans-European Road Network (consolidated version)
- Create Table of Concordance showing level of harmonization of Rulebook amending Rulebook on minimum safety conditions that must be met in tunnels created, harmonized with Directive 2004/54/EC on minimum safety requirements for tunnels in the Trans-European Road Network (consolidated version)
- Create Rulebook on Amendments to the Rulebook on the Method of Assessing the Impact of State Roads on Traffic Safety, Revision and Verification of Safety of the State Roads harmonized with Directive (EU) 2019/1936 amending Directive 2008/96/EC on road infrastructure safety management (consolidated text)
- Create Table of Concordance showing level of harmonization of Rulebook on amendments to the Rulebook on the Method of Assessing the Impact of State Roads on Traffic Safety, Revision and Verification of Safety of the State Roads with Directive (EU) 2019/1936 amending Directive 2008/96/EC on road infrastructure safety management (consolidated text)
- Daily liaise with MoT Railways Directorate officers to enhance smooth enforcement and knowledge transfer on the implementation of the amended Law on Roads and the two amended Rulebooks.
- Any changes made to the specific provisions of the ToR of the project and the Contractor's offer regarding the performance of the above tasks shall be subject to agreement with the KE2, Team Leader, Contractor and project beneficiaries. An expert cannot propose or accept any changes or make any changes to project activities without the prior approval of KE2 and the Team Leader.
Required Qualifications and Experience:
- Qualification (educational background)
- University degree in law/transport sciences/technical sciences (where a university degree has been awarded on completion of four years of study in a university or equivalent institution) (required)
- General professional experience
- Minimum 10 years general professional experience (required)
- Specific professional experience
- Experience in harmonization of the national legislation with the EU Acquis (required)
- Experience on EU funded projects (preferred)
- Language skills
- Good knowledge of the English language (required)
- Knowledge of Montenegrin/Croatian/Serbian language (preferred)
- Additional assets
- Computer literacy, incl. MS Office applications (preferred)
